Terms of Service

Please read these terms carefully before using QuickSnip.

1. Agreement to Terms

By accessing or using QuickSnip ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

QuickSnip is a screen recording application that allows users to capture their screen and webcam, create recordings, and share them via generated links. The Service includes both free and paid subscription tiers with varying features and limitations.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete registration information
  • Updating your information to keep it current

You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscriptions and Billing

Paid features are billed on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis.

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refunds are provided at our discretion and in accordance with applicable law
  • Price changes will be communicated with at least 30 days notice

5. User Content

You retain ownership of all content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and transmit your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe any third party's intellectual property or privacy rights
  • Your User Content complies with all applicable laws and these Terms

6. Acceptable Use

You agree not to use the Service to:

  • Record, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe on the intellectual property rights of others
  • Record individuals without their consent where required by law
  • Distribute malware, spam, or engage in phishing
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service for any commercial purpose not expressly permitted
  • Violate any applicable local, state, national, or international law

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by QuickSnip and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

9. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are solely between you and the third party.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKSNIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless QuickSnip and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, you may request export of your User Content for a reasonable period.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuickSnip operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and QuickSnip regarding the Service and supersede all prior agreements and understandings.
